1. Acceptance of Terms

By downloading, installing, or using the AutoGauge AI application on iOS or Android, the AutoGauge Chrome extension, or related websites (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

Our Privacy Policy explains how we collect and use personal information and is part of how we operate the App.

2. Description of Service

AutoGauge provides AI-powered car analysis tools that may include:

Market value estimates based on listing and market context
Flip score and profit potential tools
Condition-oriented assessments from photos
Repair cost estimates
Safety, recall, and depreciation-related information from third-party sources
Scanning via pasted or shared listing links, the Chrome extension on a Facebook Marketplace page, and via photos you capture or upload

Features may change over time as we improve the App.

3. Accounts

Some features require an account. You are responsible for:

Providing accurate account information
Keeping your login credentials secure
All activity under your account

You may sign in with email/password, Sign in with Apple, and/or Google Sign-In where available. You must be old enough to use the App under applicable law (and at least 13).

4. Free Access, Trials, Subscriptions, and One-Time Purchases

Free Tier

New users may receive a limited number of free scans (currently one, unless we change this in the App). After free scans are used, a paid plan, trial, or scan pack may be required to continue scanning.

Free Trials

Where offered, a subscription may include a free trial. Trial length and eligibility are shown in the App Store or Google Play purchase sheet and/or the App paywall. Unless you cancel before the trial ends, the subscription converts to a paid auto-renewing plan at the then-current price.

Paid Subscriptions (Pro)

On iOS and Android, subscriptions are billed through the Apple App Store and/or Google Play
In the Chrome extension, subscriptions may be billed through Stripe (via RevenueCat Web Billing)
Prices and billing periods are shown before you confirm purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period (or as required by the store)
Manage or cancel in:

- iOS: Settings → Apple ID → Subscriptions - Android: Google Play → Payments & subscriptions → Subscriptions - Chrome / web: the billing portal linked from checkout

Refunds for App Store and Play purchases are handled by Apple or Google. Refunds for web checkout are handled through Stripe / our billing provider.

One-Time Purchases

We may offer consumable products such as scan packs (a set number of scans). These are one-time purchases through Apple, Google, or web checkout. They are not subscriptions and do not auto-renew. Unused credits remain associated with your account subject to these Terms and any stated expiration in the App (if applicable).

Pricing Changes

We may change prices for future periods. Store rules govern how price changes apply to existing subscribers.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or disassemble the App (except where prohibited from restricting that by law)
Use bots, scrapers, or automated systems to abuse the App or our APIs
Resell, republish, or commercially redistribute analysis results at scale without permission
Submit content that is illegal, harmful, infringing, or that you do not have rights to use
Interfere with other users or attempt to bypass paywalls, quotas, or security

We may suspend or terminate access for violations.

6. Third-Party Services and Listings

The App may interact with third-party services and content, including Facebook Marketplace listings, Apple, Google, Meta, RevenueCat, AI providers, and government data sources (such as NHTSA). We do not control third-party sites or listings and are not responsible for their content, availability, or policies.

Sharing a listing URL into the App (including via system share sheets where available) is optional and subject to those platforms’ rules.

7. Disclaimers

Not Financial, Legal, or Professional Advice

AutoGauge provides estimates and AI-generated analysis only. Valuations, flip scores, condition notes, and repair estimates are not guarantees and should not be your sole basis for buying, selling, financing, or pricing a vehicle.

Accuracy

While we strive for useful results:

Markets change quickly; estimates may differ from actual sale prices
Photo-based assessments cannot detect all hidden mechanical, structural, title, or history issues
Repair estimates are approximate and vary by region and shop
Always obtain a professional inspection and do your own due diligence before a transaction

Third-Party Data

Safety, recall, and similar data may come from third parties (including NHTSA). Market signals may come from listings and models we use. We do not guarantee completeness or accuracy of third-party data.

“AS IS”

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Limitation of Liability

To the maximum extent permitted by law, AutoGauge AI and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from:

Your use of or inability to use the App
Vehicle purchase or sale decisions made using our analysis
Inaccuracies in valuations, reports, or estimates
Unauthorized access to your account
Third-party services, stores, ads, or data

Our total liability for any claim relating to the App shall not exceed the greater of (a) the amount you paid us for the App in the 12 months before the claim or (b) USD $50, to the extent such cap is allowed by law.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted.

9. Intellectual Property

The App—including design, software, branding, and models—is owned by AutoGauge AI or its licensors. You may not copy, modify, distribute, or create derivative works from the App without written permission.

Analysis results generated for your scans are yours to use for personal or internal business purposes. You may share individual results, but you may not systematically scrape, extract, or republish App data.

10. Privacy and Communications

Your use of the App is also subject to our Privacy Policy. If you enable push notifications, we may send transactional or product-related messages (for example, scan completion). You can disable notifications in device settings.

11. Account Termination

You may delete your account in the App’s Settings. Deleting your account removes account-linked data we control as described in the Privacy Policy and deletion instructions, but does not cancel an active Apple or Google subscription—you must cancel that in the store.

We may suspend or terminate accounts that violate these Terms or that create risk for the service or other users.

12. Changes to Terms

We may update these Terms from time to time. We will update the “Last Updated” date and post the revised Terms. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the App and cancel any store subscription.

13. Governing Law

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Courts located in California will have jurisdiction, subject to those mandatory protections.
